(online and offline), you acknowledge that you have read, understood, and agree with all the terms and conditions highlighted below set by NavED Academic Consulting Ltd. ("NavED"). If you don't agree with our Terms of Service below or our posted Privacy Policy, you must cease use of this website, our services, or engage in any form of transaction with NavED immediately.

These Terms and Conditions ("Terms", "Terms and Conditions") govern your relationship with https://navedacademicconsulting.ca website and NavED Academic Consulting Inc. ("us", "we", or "our").

Please read these Terms and Conditions carefully before using our website, engaging in our services or any form of transaction with us. 

Your access to, and use of, our website, our services or any form of transaction with us, is based on your acceptance of, and compliance with, these Terms. These Terms apply to all visitors, users, businesses and others who access or use our website, our services or form any type of transaction or relationship with us.

By accessing or using our Service you agree to be bound by these Terms and Conditions, and accept all legal consequences. If you do not agree to these terms and conditions, in whole or in part, please do not use our Service.

 

DISCLAIMER

NavED is an academic consulting firm, and while we strive to provide you with information and resources to guide your post-secondary educational path, we cannot guarantee results or outcomes. It is our primary goal to provide you with essential information and tools to assist you with decisions relating to your post-secondary education; however, we cannot – in any shape or form – complete any applications on your behalf, write your letters, CV (resume), autobiographical plans, scholarship/awards letters, etc. It is the responsibility of the applicants to follow the specific instructions of the school of their choice to ensure the safe and timely arrival of their documents/applications. It should be understood that students are required to meet post-secondary academic requirements and/or deadlines as established by their school of choice.  Additionally, NavED operates in an ethical manner and all data presented is obtained through publicly available sources. Please note that NavED is not affiliated with, nor do we endorse, any school or organization, including but not limited to universities, colleges, (private or public), school administrators or any external websites, unless explicitly indicated. For example, OSAP is an acronym for the Ontario Student Assistance Program, which is a student-centered grants and loans program administered and provided by both the Ontario and federal governments. For specific information regarding OSAP and application instructions and details, students should visit: https://www.ontario.ca/page/osap-ontario-student-assistance-program, or contact their institution's Financial Aid Office.

 

SESSION/MEETING FEES

You agree to make the requested payment for information sessions and/or consulting meetings in the amount(s) listed in our secure checkout page for each program or the custom communication you receive via email. You must complete payment prior to attending the session or commencement of the consulting meeting.

 

INTELLECTUAL PROPERTY

The Service and all contents, including but not limited to text, images, videos, presentations, protocols, or graphics are the property of NavED, and are protected as intellectual property. You may not copy, download or print any portions of the material from the different areas of the Service for any use other than in the course of use of our platform and services. Any use outside of such use - whether for personal or commercial use - is strictly prohibited. These Terms do not grant you a license to use any trademark of NavED or its affiliates. You further agree not to use, change or delete any proprietary documents from materials downloaded or received from the Service.

 

COPYRIGHT

The material produced on this website is the property of NavED Academic Consulting Ltd. and any copying, reproduction and/or redistribution of this material, without the express written consent of NavED, is strictly prohibited and could result in legal action.

CANCELLATION AND REFUND POLICY

With regard to cancellations of booked sessions, we ask that you provide us with at least 14 days notice to receive a full refund.  Refunds will be in the same form as the payment.

Within 13 days of your booked session, no refund is available, but you can reschedule (i.e. attend an alternative session within one year) at no extra cost.

All refund notices are processed as “NavED credits”. The amount owed must be converted to NavED credits and can be used towards any NavED service for a period of one (1) year from the date of purchase and any unused credits will expire thereafter and no refunds will be issued.

PROMOTIONAL OFFERS

Promotional offers are at the sole discretion of NavED and can change at any time without notice. If a promotional offer includes an additional gift with purchase (e.g. Amazon gift card, discount, or additional products/services, etc.), the gift must be returned in its original format and unused in the event of a request for a refund. If the promo gift is used or not returned, there will be no refunds and the refund policy above does not apply. Additionally, all promotional offer gifts will only be distributed after you have attended at least one session with us. Acceptance and use of any promotional gift will imply you have been happy with our services and nullifies any 100% satisfaction guarantee claims. 

 

MENTION OF OTHER ORGANIZATIONS & INDIVIDUALS

Our website may include mention of other Organizations. No such mention should be perceived as affiliation or endorsement of any third parties by NavED or vice versa unless otherwise explicitly stated.

 

LINKS TO OTHER WEBSITES

The website may contain links to third-party websites or services that are not owned or controlled by NavED.

NavED has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that NavED shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such websites or services.

We strongly advise you to read the Terms and Conditions, and privacy policies, of any third-party websites or services that you visit.

 

AVAILABILITY, ERRORS AND INACCURACIES

In order to provide exceptional service, and accuracy, we regularly update the products and services on our website.

We cannot and do not guarantee the accuracy or completeness of any information, including prices, product images, specifications, availability, and services. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.

Despite our best efforts, the products or services available on our Service may have an error regarding the price, be inaccurately described, or be unavailable. We may experience delays in updating information on the Service and in our advertising on other websites.

 

FEE CHANGES

NavED in its sole discretion and at any time, may modify the group information session fees and/or consulting fees.

 

USER CONTENT

If you submit comments, photos and other content to us (“User Content”) through Site(s), social media communities, survey responses, email or otherwise, you grant us an irrevocable, royalty-free, perpetual, transferable, license to use, modify, create derivative works from, publish, display and sub-license User Content, in whole or in part, in any format and on any platform either now known or hereinafter invented, and to associate User Content with your name and/or likeness; you are solely responsible for your User Content. You represent that you have the right to submit User Content to us and the right to grant us the license described above. You warrant that User Content, and our use thereof, does not and will not infringe any patent, trademark, trade secret, copyright, or other intellectual or proprietary or privacy right of any party or individual.

 

SESSION CHANGES

NavED frequently updates, revises and modifies sessions, including session content, features and services. NavED reserves the right to make changes to sessions, features and services at any time.  

 

INDEMNIFICATIONS

You agree to indemnify, defend and hold harmless NavED, its principals, officers, directors, representatives, employees, contractors, licensors, licensees, suppliers and agents, from and against any claims, losses, damages, losses, obligations, costs, actions or demands.

These include but are not limited to: (a) legal and accounting fees resulting from your attendance at our group information sessions or or one-on-one consulting fees; (b) your breach of any of these Terms; and, (c) anything you may post on our website. 

 

DISCLAIMER AND NON-WAIVER OF RIGHTS

NavED makes no guarantees, representations or warranties of any kind as regards to the website and associated technology. Any purportedly applicable warranties, terms and conditions are excluded, to the fullest extent permitted by law. Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to:  implied warranties of merchant-ability, fitness for a particular purpose, non-infringement or course of performance, except as provided for under the laws of any province in Canada. In such cases, the provincial law shall apply to the extent necessary.

If you breach any of these Terms and NavED chooses not to immediately act, or chooses not to act at all, NavED will still be entitled to all rights and remedies at any later date, or in any other situation, where you breach these Terms. NavED does not waive any of its rights. NavED shall not be responsible for any purported breach of these Terms caused by circumstances beyond its control. A person who is not a party to these Terms shall have no rights of enforcement. You may not assign, sub-license or otherwise transfer any of your rights under these Terms.

 

EXCLUSIONS

As set out above, some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, so the limitations above may not apply to you. Provincial laws of Canada may apply to certain products and services provided.

 

GOVERNING LAW

These Terms shall be governed by, and interpreted and enforced in accordance with, the laws in the Province of Ontario and the laws of Canada, as applicable.

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, then any remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements, oral or otherwise, regarding our Service.

 

CHANGES

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, in whole or in part, please stop using the website and our Service.
